Tradicionalmente, se ha argumentado que el concepto de eudaimonía en Aristóteles se encuentra anclado en el contexto de una comprensión teleológica del universo, por cuanto dicha noción parece radicar en una definición funcionalista de la naturaleza humana. Teniendo esto en mente, Bernard Williams ha desarrollado una crítica en contra de la propuesta ética de Aristóteles, acusándola de una cierta ambición científica en el campo del razonamiento práctico que resulta insostenible actualmente. Este ensayo busca discutir si, en efecto, estos señalamientos tienen (...) un sustento plausible o si, por el contrario, se basan en una interpretación debatible de los fundamentos de la ética aristotélica. Con este propósito, se analiza la justificación del razonamiento ético de Aristóteles a la luz de los argumentos de Williams y de algunos de sus contradictores. (shrink)

No pretende esta ser una edición exhaustiva, pero no por ello deja de significar la presente (...) una amplia selección de estudios de ámbito internacional sobre el significado filosófico de Leibniz como pensador abierto, plural y conciliador. Son aquí objeto de estudio las diferentes vías de comunicación entabladas por Leibniz con la tradición, con su época o con la filosofía posterior. Why do we have social norms—of fairness, cooperation, trust, property, or gender? Modern-day Humeans, as I call them, believe these norms are best accounted for in cultural evolutionary terms, as adaptive solutions to recurrent problems of social interaction. In this paper, I discuss a challenge to this “Humean Program.” Social norms involve widespread behaviors, but also distinctive psychological attitudes and dispositions. According to the challenge, Humean accounts of norms leave their psychological side unexplained. They explain, say, why we share equally, (...) but not why we disapprove of those who don’t. I defend the Humean Program against this challenge. In particular, I suggest an idea for how to extend the Program to account for the psychological side of norms. Socially adaptive behaviors aren’t just likely to emerge in a group; They are also likely to be widely taught within it. The transmission of these behaviors through instruction explains why they are associated with distinctive normative attitudes and dispositions. These attitudes play a pedagogical role in helping transmit these behaviors to children and newcomers. (shrink)

The study's general objective is to determine the students' stance on the most appropriate model of writing skills, using Structural Equation Modeling (SEM) as a basic design in the relationship of self-regulated learning strategies, communicative learning strategies, learning grammatical strategies, and writing skills. This study used a mixed-method sequential explanatory design, in which quantitative design is more widely used than qualitative Creswell, J., & Creswell, D. (2017). The researcher used the stratified random sampling technique for selecting respondents and, by using (...) the Raosoft sample size calculator, identified 390 respondents using a four-part questionnaire to collect data. Purposive sampling is the method for determining participants in a qualitative design using a guided questionnaire to obtain data from In-Depth Interviews and Focus Group Discussions. Model 5 was the best-fitting model for writing skills, showing significant correlations with the exogenous variables: self-regulated learning strategies, communicative learning strategies, learning grammatical strategies, and writing skills as endogenous variables. Both the exogenous and endogenous variables obtained a high level of overall description, meaning that students often practiced strategies to cultivate writing skills. The participants' stance on the most appropriate model is essential for tertiary students to have different strategies for developing writing skills. It is necessary to reach the full description of the highest level by using different strategies to build writing skills. (shrink)

It is still common to find the traditionalist and rationalist conception that scientific knowledge is the most accurate way of describing natural data, as if, therefore, the notion of knowledge were identical to the notion of natural science. In this article, this conception is problematized, based on some concrete cases of the history of science that seem to show that the beliefs of natural science can also be explained on the basis of non-scientific beliefs, such as the beliefs of sociology, (...) psychology, history and philosophy. That is, the main purpose of this paper is to argue that the assessment one can have of scientific clarity can not be constructed only through explanations provided by the procedures of natural science, but also through explanations provided by the procedures of other distinct areas. This argument runs counter to traditionalist rationalism and will be used in this article to criticize the conception that knowledge, in order to be valid, will necessarily have to be scientific and rational. O objetivo principal deste trabalho é apresentar a distinção entre ciência e cientificismo e, com base no trabalho de van Fraassen, intitulado A imagem científica (2006), discutir sobre as circunstâncias em que o cientificismo poderia ser repudiado. O cientificismo é uma corrente de pensamento que somente considera válido um conhecimento se ele for científico. Segundo essa corrente, os procedimentos da ciência natural seriam mais especiais, uma vez que, dentre outros motivos, eles são capazes de descrever regularidades e possibilitar predições. Dessa (...) forma, o cientificismo defende que os procedimentos não científicos não possuem valor algum, pois não seriam capazes de descrever regularidades e realizar predições como fazem os procedimentos da ciência natural. Trataremos de maneira crítica essa concepção, apresentando o argumento de van Fraassen de que a descrição de uma regularidade também pode ser construída por explicações não científicas. Em sua opinião, o poder explicativo de uma teoria vai além de sua importância empírica, ele é radicalmente dependente do contexto. Isso significa que as regularidades descritas por uma crença científica são também dependentes de explicações não científicas, como as explicações da psicologia, da história, da filosofia, da sociologia, etc. Assim, a forte predição que encontramos na ciência natural não é realizada somente com base na adequação empírica e científica, mas com base em um sistema de explicações não científicas. Isso torna incorreta a classificação do conhecimento científico como o mais verdadeiro ou especial por ser capaz de descrever regularidades e realizar a predições. Pretende-se, com isso, refletir se o conhecimento pode ser construído por outras áreas não científicas, sem que o conhecimento seja com isso prejudicado. Uma reflexão necessária que servirá para apresentar um dos problemas que tornam o cientificismo indesejável. (shrink)

El interés de este estudio recae no sólo en transparentar la articulación histórica y teórica en que tienen lugar las etapas que preceden la redacción misma de los Nuevos Ensayos de Leibniz -equivalente a un período de casi diez años y que coincide con el punto de arranque de la maduración definitiva de su filosofía-, sino (...) también en atenuar la connotación estrictamente epistemológica que suele atribuírsele a dicha obra, subrayando las motivaciones metafísicas y teológicas que lo impulsaron a redactarla en respuesta al Ensayo sobre el entendimiento humano de Locke. According to many philosophers, rationality is, at least in part, a matter of one’s attitudes cohering with one another. Theorists who endorse this idea have devoted much attention to formulating various coherence requirements. Surprisingly, they have said very little about what it takes for a set of attitudes to be coherent in general. We articulate and defend a general account on which a set of attitudes is coherent just in case and because it is logically possible for the attitudes to (...) be jointly satisfied in the sense of jointly fitting the world. This article explores the concept of subjectivity as developed in the work of French thinker Michel Foucault. It connects this concept to discussions about the governance of people living with HIV and the processes of subjectivation. The article highlights the analytical potential of Foucault's framework for studying human conduct in post-disciplinary societies. We use Foucault's late thoughts as a theoretical framework to examine HIV from a biopolitical perspective that considers the processes of subjectivation experienced by HIV-positive individuals. O objetivo deste trabalho é apresentar as ponderações de Nietzsche sobre a filosofia nascente de Tales de Mileto com base em trechos selecionados dos ensaios nietzschianos do período da juventude intitulados A filosofia na época trágica dos gregos e Sobre verdade e mentira no sentido extramoral, da obra do período de transição A gaia ciência, assim como da obra do período mais tardio de sua vida intitulada Genealogia da moral, uma polêmica. Os trechos são suficientes para enfatizar o “erro” presente (...) na hipótese da água e as implicações da “intuição filosófica” de Tales para a representação da phýsis. Nietzsche pondera que a contemplação de Tales foi movida por uma crença ilógica, fantasiosa e indemonstrável, que encontramos em todos os filósofos, de que é possível acessar a realidade objetiva pelo “conhecimento”. Pondera ainda que o “filosofar indemonstrável” de Tales tem ainda o seu valor em pretender ser em todo caso não místico e não alegórico. Essas ponderações de Nietzsche sobre o filosofar de Tales servem neste trabalho para consolidar a perspectiva nietzschiana de que o conhecimento em suas formas de representar a “vida”, desde Tales, é movido pela crença ilógica na “verdade”, não na “aparência”. Frente a quienes sostienen una incompatibilidad entre historia de la filosofía y filosofía, en cuanto plantean una disyuntiva entre una práctica descriptiva y una argumentativa, en este trabajo nos proponemos mostrar, examinando la labor histórico-filosófica de Aris- tóteles, que esa disyuntiva no es excluyente. Para ello, en primer lugar, examinaremos algunos pasajes de su obra en los que ofrece indicaciones metodológicas que permiten comprender la doble función que cumplen las exposiciones críticas de los filósofos precedentes en la constitución misma de (...) su filosofía. En segundo lugar, ilustraremos el tipo de argumentación aristotélica a través del análisis de las críticas que dirige a las Ideas platónicas como causas. Contra Platón, Aristóteles establece que, para dar cuenta de la ingenerabilidad e incorruptibilidad de las formas, no es necesario caracterizarlas como entidades separadas de la materia y del movimiento. Basta asegurar la eternidad de la forma a través de su reproducción en otros individuos de la misma especie. Tal análisis nos permite concluir, finalmente, que filosofía o historia de la filosofía constitu- yen una falsa disyuntiva en Aristóteles, por lo que el examen dialéctico de las doctrinas precedentes es un método adecuado de indagación filosófica. The aim of this article is to present the assumptions of Nietzsche's critique of the notion of “truth” that allow to consider his “perspectivism” an excellent critical and epistemological alternative to philosophy of science. It takes place, therefore, an interpretation of the Nietzschean expressions “tragedy”, “tragic knowledge”, “life”, “perspectivism” and “truth”. Nietzsche seems to be convinced that the belief in the notion of “truth” cannot be consistent with “life”, since “life” is also “tragedy” and therefore cannot be reduced to a (...) concept. On the other hand, the notion of “truth” found in natural science seeks to consolidate a concept about reality, which nullifies the plurality of perspectives on life. Thus, an analogy between this aspect behind Nietzsche's perspectivism and the construction of scientific knowledge allows us to consider that the construction of scientific knowledge needs to disregard the notion of truth and to consider all the individual perspectives of scientists – science must not seek truths but metaphors or perspectives on “life” – which allows to show an excellent contribution of Nietzsche to the debates about the notion of truth in the philosophy of science. In this paper I argue that the search for explainable models and interpretable decisions in AI must be reformulated in terms of the broader project of offering a pragmatic and naturalistic account of understanding in AI. Intuitively, the purpose of providing an explanation of a model or a decision is to make it understandable to its stakeholders. But without a previous grasp of what it means to say that an agent understands a model or a decision, the explanatory strategies will (...) lack a well-defined goal. Aside from providing a clearer objective for XAI, focusing on understanding also allows us to relax the factivity condition on explanation, which is impossible to fulfill in many machine learning models, and to focus instead on the pragmatic conditions that determine the best fit between a model and the methods and devices deployed to understand it. After an examination of the different types of understanding discussed in the philosophical and psychological literature, I conclude that interpretative or approximation models not only provide the best way to achieve the objectual understanding of a machine learning model, but are also a necessary condition to achieve post hoc interpretability. This conclusion is partly based on the shortcomings of the purely functionalist approach to post hoc interpretability that seems to be predominant in most recent literature. (shrink)

The method consists of carrying out a conceptual analysis of selected excerpts from theCritique of pure reasonthat may serve to support the interpretation that the analogies of experience are, for Kant, rules that determine the necessary links between perceptions and the ability to understand phenomena. from them. In this way, we (...) seek to explain the divergence between pure knowledge and empirical knowledge, as well as the way in which physics manages to maintain its a priori concepts. -/- O objetivo deste artigo é abordar a maneira como Kant considera as “analogias da experiência” ligações necessárias para ocorrer a representação científica do mundo físico. O método consiste em analisar trechos selecionados da Crítica da razão pura, sobretudo do texto “Analítica dos princípios”, que apresentem as analogias da experiência como regras que determinam as ligações necessárias entre as percepções e a capacidade de compreensão dos fenômenos. Kant argumenta que embora os objetos sejam em si mesmos inacessíveis a nós isto não implica a impossibilidade de pensarmos neles. O resultado é uma perspectiva sobre o conhecimento científico capaz de considerar as analogias da experiência para manter alguns conceitos a priori sobre o mundo físico. (shrink)

The purpose of this article is to present the influence of Plotinus' thought on the political philosophy of the Roman Emperor Julian, between the years 361 to 363. The methodology consists of selecting excerpts from the works of Juliano Misopogon and Cartas y Fragmentos that may indicate the influence of the ideas of Plotinus' Ennead in the speech given by the Emperor to legitimize his political power. Juliano argues that the laws of the empire were created by the gods for (...) the organization of human life, so that obedience to the gods necessarily requires an obedience to those laws. According to Juliano, knowledge or episteme about the laws of empire is conditioned to the escape from sensible reality in the name of spiritual reality, in which the wise ruler also needs to transcend the body to know and obey divine laws. Thus, after analyzing Juliano's arguments, we seek to reflect on the viability of the political system adopted by him, especially if the reception of his ideas by rulers from the 20th century onwards is considered. A essa primeira causa de tudo, onde toda a ordem e (...) leis tiveram início, a qual para ele assume um caráter divino, Newton aponta para um Deus sábio e poderoso e responsável pela ordem inteligente e pela a harmonia das leis físicas e universais de tudo o que existe – Deus como criador e preservador da ordem do universo. Há ainda a analogia do conceito de Deus com o espaço e o tempo, na medida em que ambos comunicam infinitude e onipresença. Por fim, nas considerações finais apontarei a importância de Newton para a metafísica moderna e como os seus estudos contribuíram para uma visão posterior do universo e suas leis e do homem enquanto ser pensante. John McDowell and Bill Brewer famously defend the view that one can only have empirical beliefs if one’s perceptual experiences serve as reasons for such beliefs, where reasons are understood in terms of subject’s reasons. In this paper I show, first, that it is a consequence of the adoption of such a requirement for one to have empirical beliefs that children as old as 3 years of age have to considered as not having genuine empirical beliefs at all. But we (...) have strong reasons to think that 3-year-old children have empirical beliefs, or so I argue. If this is the case, McDowell and Brewer’s requirement for one to have empirical beliefs faces a strong challenge. After showing this, I propose an alternative requirement for one to have empirical beliefs, and argue that it should be favoured over McDowell and Brewer’s requirement. (shrink)

The purpose of this work is to present the analogy between the thoughts of Epicurus de Samos and Friedrich Nietzsche regarding the notion of “freedom”. In Epicurus, the idea of “freedom” (eleuthería) is linked to the idea of “self-assertion” (autárkeia), since “freedom” for Epicurus means the “exercise of wisdom” through the autonomy of the “sage” (sophós, prhóneo) when it is free to act according to thought. In a similar way, in Nietzsche the idea of freedom (Freiheit) is linked to the (...) idea of “affirming life” (Lebensbejahung) – and “of oneself” – in acting, when the “superman” (Übermensch) is above of good and evil and being able to create and determine their own values. The discussion about freedom, according to the thought of Epicurus and Nietzsche, makes it possible to identify the analogy between them regarding the understanding of the importance of freedom in philosophical action, in addition to promoting a reflection on thinking and acting in the world. O modus operandi newtoniano não negava este ou aquele método epistêmico, simplesmente, por divergirem em seus procedimentos, mas, encarava-os como métodos que podiam andar juntos, na construção do conhecimento científico. O objetivo deste artigo é apontar cinco aspectos do pensamento nietzschiano que podem ser relevantes para os debates da filosofia da ciência em torno da natureza e representação do conhecimento científico. Para tanto, é realizada uma revisão de literatura com o objetivo de selecionar trechos de obras nietzschianas como O nascimento da tragédia, Genealogia da moral, A gaia ciência e outras que permitam interpretar Nietzsche como um filósofo da ciência preocupado com a construção do conhecimento cientifico sobre a realidade física. Como resultado é possível identificar uma proposta epistemológica na perspectiva nietzschiana, cuja representação objetiva do mundo deve apontar para uma estética da vida. -/- The purpose of this article is to point out five aspects of Nietzschean thought that may be relevant to debates in the philosophy of science around the nature and representation of scientific knowledge. To this end, a literature review is carried out with the aim of selecting excerpts from Nietzschean works such as The Birth of Tragedy, Genealogy of Morals, The Gay Science and others that allow us to interpret Nietzsche as a philosopher of science concerned with the construction of scientific knowledge about the physical reality. As a result, it is possible to identify an epistemological proposal in the Nietzschean perspective, whose objective representation of the world should point to an aesthetics of life. (shrink)

Many word forms in natural language are polysemous, but only some of them allow for co-predication, that is, they allow for simultaneous predications selecting for two different meanings or senses of a nominal in a sentence. In this paper, we try to explain (i) why some groups of senses allow co-predication and others do not, and (ii) how we interpret co-predicative sentences. The paper focuses on those groups of senses that allow co-predication in an especially robust and stable way. We (...) argue, using these cases, but focusing particularly on the multiply polysemous word ‘school’, that the senses involved in co-predication form especially robust activation packages, which allow hearers and readers to access all the different senses in interpretation. In the natural and social sciences, it is common to use toy models—extremely simple and highly idealized representations—to understand complex phenomena. Some of the simple surrogate models used to understand opaque machine learning (ML) models, such as rule lists and sparse decision trees, bear some resemblance to scientific toy models. They allow non-experts to understand how an opaque ML model works globally via a much simpler model that highlights the most relevant features of the input space and their effect on (...) the output. The obvious difference is that the common target of a toy and a full-scale model in the sciences is some phenomenon in the world, while the target of a surrogate model is another model. This essential difference makes toy surrogate models (TSMs) a new object of study for theories of understanding, one that is not easily accommodated under current analyses. This paper provides an account of what it means to understand an opaque ML model globally with the aid of such simple models. (shrink)

Current work in language models (LMs) helps us speed up or even skip thinking by accelerating and automating cognitive work. But can LMs help us with critical thinking -- thinking in deeper, more reflective ways which challenge assumptions, clarify ideas, and engineer new concepts? We treat philosophy as a case study in critical thinking, and interview 21 professional philosophers about how they engage in critical thinking and on their experiences with LMs. We find that philosophers do not find LMs to (...) be useful because they lack a sense of selfhood (memory, beliefs, consistency) and initiative (curiosity, proactivity). We propose the selfhood-initiative model for critical thinking tools to characterize this gap. Using the model, we formulate three roles LMs could play as critical thinking tools: the Interlocutor, the Monitor, and the Respondent. We hope that our work inspires LM researchers to further develop LMs as critical thinking tools and philosophers and other 'critical thinkers' to imagine intellectually substantive uses of LMs. (shrink)

There is a growing awareness that there are many subtle forms of exclusion and partiality that affect the correct workings of a judicial system. The concept of epistemic injustice, introduced by the philosopher Miranda Fricker, is a useful conceptual tool to understand forms of judicial partiality that often go undetected. In this paper, we present Fricker’s original theory and some of the applications of the concept of epistemic injustice in legal processes. In particular, we want to show that the seed (...) planted by Fricker has flourished into a rich field of study in which the concept is used to analyze many different phenomena in law, not always following the original characterization provided by her. This has led to a distinction between what we will call the narrow version of the concept, which is closer to Fricker’s original account, and the wider version of epistemic injustice, which is a more controversial notion because it is always on the verge of morphing into other well-known concepts like sexism, racial discrimination, oppression, silencing, and gaslighting. We will show that the value of the narrow version is mostly theoretical, and that in order to use the concept of epistemic injustice one must adopt a more liberal understanding of it. (shrink)

Así pues, la persona posee un “horizonte interior”, absolutamente novedoso y que le caracteriza como ser en aproximación a la Verdad y a la Libertad, las cuales no sólo son específicas del propio humano, sino que le son necesarias en cuanto remedios contra la desolación y la tiranía. This paper is an attempt to clarify, from a Thomistic point of view, the nature and method of metaphysics. I argue that metaphysics' object is created being, not God, even if God enters metaphysics as efficient cause of metaphysic's object. Also, that metaphysics is a science, insofar as a particular kind of coherent reasoning process, going from the many to understand a certain oneness, and then from that oneness to reinterpret the many. The use of machine learning algorithms has become ubiquitous in hiring decisions. Recent studies have shown that many of these algorithms generate unlawful discriminatory effects in every step of the process. The training phase of the machine learning models used in these decisions has been identified as the main source of bias. For a long time, discrimination cases have been analyzed under the banner of disparate treatment and disparate impact, but these concepts have been shown to be ineffective in the (...) context of AI. This paper examines the possibility of studying algorithmic discrimination from the perspective of negligence law. Negligent selection and validation of datasets and classifiers is a salient cause of improper training in machine learning. It is a breach of an employer’s duty to protect others, a failure of its exercise of due care in the manner of choosing employees. Adopting negligence to algorithmic discrimination requires a reformulation of what is foreseeable and reasonable within the context of black box algorithms, and a shift in the burden of proof to the employer, who must present evidence of its efforts to avoid bias. This paper is my best attempt to confute (Kantian) Modern Philosophy at its very core. This implies, of course, that in my view the principles of Critical Realism are Kantian. The basic arguments supporting Critical Realism are powerful: I have tried to show clearly their power, but also to expose clearly their putrid root. In this paper, I examine Pascal's Wager as a decision problem where the uncertainty is massive, that is, as a decision under ignorance. I first present several reasons to support this interpretation. Then, I argue that wagering for God is the optimal act in a broad range of cases, according to two well-known criteria for decision-making: the Minimax Regret rule and the Hurwicz criterion. Given a Pascalian standard matrix, I also show that a tie between wagering for God and wagering (...) against God is only possible under very narrow conditions when applying the Hurwicz criterion. Finally, I discuss three objections to these two versions of the Wager. The most pressing challenge comes from the Many-Gods objection. I conclude that this objection is even more challenging whenever one faces a situation of massive uncertainty about God's existence. I argue that addressing it requires a more detailed examination of the benefits of adopting a religious life compared to those of choosing non-theism, or an additional criterion that can break the tie between these options. Uno de los principios éticos mencionados más frecuentemente en los lineamientos para el desarrollo de la inteligencia artificial (IA) es la transparencia algorítmica. Sin embargo, no existe una definición estándar de qué es un algoritmo transparente ni tampoco es evidente por qué la opacidad algorítmica representa un reto para el desarrollo ético de la IA. También se afirma a menudo que la transparencia algorítmica fomenta la confianza en la IA, pero esta aseveración es más una suposición a priori que una (...) tesis basada en evidencia empírica. Tampoco se discute mucho hasta qué punto es técnicamente posible volver transparente la caja negra de la IA a través de los métodos de explicabilidad. En este capítulo haré un análisis de la interrelación entre los conceptos de transparencia, explicabilidad y confianza. Inicialmente, analizaré los diferentes tipos de opacidad algorítmica para entender mejor cuál es el problema al que nos enfrentamos. Unlike other classical arguments for the existence of God, Pascal’s Wager provides a pragmatic rationale for theistic belief. Its most popular version says that it is rationally mandatory to choose a way of life that seeks to cultivate belief in God because this is the option of maximum expected utility. Despite its initial attractiveness, this long-standing argument has been subject to various criticisms by many philosophers. What is less discussed, however, is the rationality of this choice in situations where the (...) decision-makers are confronted with greater uncertainty. In this paper, I examine the imprecise version of Pascal’s Wager: those scenarios where an agent’s credence that God exists is imprecise or vague rather than precise. After introducing some technical background on imprecise probabilities, I apply five different principles for decision-making to two cases of state uncertainty. In the final part of the paper, I argue that it is not rationally permitted to include zero as the lower probability of God’s existence. Although the conditions for what makes an act uniquely optimal vary significantly across those principles, I also show how the option of wagering for God can defeat any mixed strategy under two distinct interpretations of salvation. Los sesgos cognitivos afectan negativamente la toma de decisiones en todas las esferas de la vida, incluyendo las decisiones de los jueces. La imposibilidad de eliminarlos por completo de la práctica del derecho, o incluso de controlar sus efectos, contrasta con el anhelo de que las decisiones judiciales sean el resultado exclusivo de un razonamiento lógico-jurídico correcto. Frente el efecto sistemático, recalcitrante y porfiado de los sesgos cognitivos, una posible estrategia para disminuir su efecto es enfocarse, no en modificar el (...) comportamiento de los agentes judiciales, sino en moldear su entorno para que los sesgos tengan menos oportunidades de aparecer. En particular, es más provechoso concentrar los esfuerzos en identificar aquellas reglas procesales que faciliten o limiten el efecto de los sesgos. En este ensayo propongo un diálogo fructífero entre el derecho y la psicología que puede llevar a mejorar la calidad de los sistemas judiciales. La propuesta está basada en la creación de guías de práctica judicial que puedan servir de base para la creación de protocolos procesales que limiten en la medida de lo razonable sus efectos negativos y conduzcan a mejores decisiones judiciales. Resumen: Una de las formas más comunes y menos estudiadas de parcialidad judicial subjetiva es la disminución de la credibilidad otorgada a un testigo debido a un prejuicio identitario implícito del agente judicial. En la epistemología social, este fenómeno ha sido estudiado bajo la rúbrica de la injusticia testimonial. En este ensayo mostramos que para determinar la ocurrencia de un caso de injusticia testimonial en el derecho se deben cumplir tres condiciones que son imposibles de verificar empíricamente y que están (...) basadas en presupuestos psicológicos que han sido puestos en duda en años recientes. Sin la posibilidad de verificar estas condiciones, estamos frente a un tipo de parcialidad judicial indetectable. En su lugar, ofrecemos una nueva forma de entender la injusticia testimonial en el derecho como un fenómeno más general que describe una tendencia comportamental prejuiciosa recurrente por parte de un agente judicial. Entendida de este modo, la injusticia testimonial es completamente verificable. -/- Abstract: One of the most common and least studied forms of subjective judicial partiality is the credibility deficit suffered by a witness due to an implicit identity prejudice in a judicial agent. Social epistemologists have studied this form of partiality under the rubric, “testimonial injustice.” In this essay we argue that to verify the occurrence of a singular instance of testimonial injustice in law three facts must be established, none of which can be established with any degree of confidence. Furthermore, all of them are based on psychological suppositions that have been recently discredited. Without the possibility of establishing these facts, we end up with an undetectable form of subjective judicial partiality. In its place, we offer a new way of understanding testimonial injustice in law as a general phenomenon that describes a recurrent pattern of prejudiced behavior in a judicial agent. Under this characterization, testimonial injustice becomes empirically verifiable. (shrink)

In this paper I defend the idea that there is a sense in which it is meaningful and useful to talk about objective understanding, and that to characterize that notion it is necessary to formulate an account of explanation that makes reference to the beliefs and epistemic goals of the participants in a cognitive enterprise. Using the framework for belief revision developed by Isaac Levi, I analyze the conditions that information must fulfill to be both potentially explanatory and epistemically valuable (...) to an inquiring agent and to a scientific community. To be potentially explanatory, the information must state the relations of probabilistic relevance that the explanans bares to the explanandum. But a potential explanation con only be a bona fide explanation if it becomes part of inquiry, that is, if an agent or a group of agents can see any value in it for their cognitive purposes. I provide a way to evaluate the epistemic value of a potential explanation as a function of its credibility and its informational content. (shrink)

The objective of this work is to present Michel Foucault's perspective on the formation of moral subjectivity according to his text entitled “The use of pleasures and the techniques of self”. In the referred text, Foucault emphasizes that moral action should not be constituted in acts according to a rule of conduct supported by moral concepts, but in acts according to a pure relation of the subject with his internal wisdom (subjectivity), a relationship that should not be understood as simply (...) a “self-awareness” as a moral subject, but as a “constitution of the self” as a moral subject In this article, Foucault's position on the formation of moral subjectivity is considered to analyze the place of desire in the autonomy of oneself and of practical attitudes, especially if they are considered: the subject's experience as a process in which both subjectivity and desires are modified or annulled by specific norms or laws, established in certain societies and culture, almost always linked to norms of sexuality; the power of the strongest, insofar as it influences institutions to spread interests in society, corrupting the particular desires of individuals; the “techniques of self”, as rational and voluntary practices that curb desires, by which human beings determine for themselves rules of conduct that correspond to aesthetic values. The objective of this work is to present Ludwig Wittgenstein's perspective on the impossibility of the existence of philosophical problems, to then reflect on the implications of such a perspective based on Popper's thought. For that, Wittgenstein's perspective, as exposed in his work Tractatus logico-philosophicus, is contrasted with Karl Popper's perspective presented in “The nature of philosophical problems and their scientific roots” (in Conjectures and refutations). The example of the problem faced by Kant in his work Critique of pure reason (...) will also be considered for the analysis of Wittgenstein's argument. According to Wittgenstein, philosophical problems are pseudo-problems because they have no solution. However, despite admitting the existence of pseudo-problems, Popper argues that factual, logical, or hybrid problems, under certain circumstances, can be philosophical. Thus, the aim is to contrast these two perspectives in order to emphasize how not all philosophical problems are pseudo-problems. (shrink)

The aesthetic purpose of the work of colonial art is to bring the Divine closer to the human, trying to reflect and communicate the (...) testimony of a mystical spiritual search and experience lived by the author, inspired and revealed by God. -/- A través de los 'Afectos Espirituales' de la Abadesa de Tunja, Sor Francisca Josefa de la Concepción del Castillo, se plantea una reflexión acerca del arte colonial en torno a la cuestión de su aparente utilidad como 'vehículo de evangelización', indagando su genuino propósito en el misticismo de la Madre del Castillo y la relación de su obra con Él. Se planteará que el propósito estético de la obra de arte colonial es acercar lo Divino a lo humano, intentado reflejar y comunicar el testimonio de una búsqueda y experiencia espiritual mística vivenciada por la autora, inspirada y develada por Dios. Rules 405(a) and 608(a) of the Federal Rules of Evidence allow the use of testimony about a witness’s reputation to support or undermine his or her credibility in trial. This paper analyzes the evidential weight of such testimony from the point of view of social epistemology and the theory of social networks. Together they provide the necessary elements to analyze how reputation is understood in this case, and to assess the epistemic foundation of a reputational attribution. The result of the (...) analysis will be that reputational testimony is extremely weak from an epistemological point of view, and that in many cases there are more reliable substitutes that achieve a similar purpose. The obvious fix, in my view, is to eliminate the use of reputation testimony to support or undermine the credibility, honesty, chastity or peacefulness of a witness. (shrink)
